We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.

GENERAL TERMS AND CONDITIONS KIDZ TRAINING

§1 Offer Physical Courses - Online Courses see §11

1The provider organizes trainings for children ("KidZ Training") within the framework of course blocks of several months.

§2 Registration

1The participating children (hereinafter referred to as "participants") are registered by their parents (hereinafter referred to as "customers") or by their legal representatives. 2The registration and participation is valid for a selected course. 3The course days of the course can be seen before registration. 4Participation in the courses is not transferable. 5Registration is made in writing by e-mail and transfer of the advertised course fee. 6The participant is considered registered only after full payment has been received. 7The advertised course fee must be received in full on the provider's account before the start of the first training session. 8Parents or legal guardians confirm that the participant has no health problems or risks. 10The provider is to be informed before the start of the course of any pre-existing medical conditions or medical, psychological and/or social problems that affect the participant's suitability for the course. 11The customer's contact details (name, address, email, cell phone number) must be provided to the provider at the time of registration. 12The customer is requested not to be present at the course location during the course hours, but undertakes to be reachable by cell phone during this time. 13There is no claim to registration and participation in the course. 14Admission to the course is reserved for the provider and can be denied without giving reasons. 15The course is booked in the order of receipt of payment. 16By registering for the course, the customer accepts the terms and conditions.

§3 Cancellation of a course by the provider

1The provider reserves the right to cancel courses if the number of participants is too low. 2Paid fees will either be credited and can be used for a later course or will be refunded.

§4 Withdrawal of registration by the customer

1The withdrawal of the registration must be made in writing. 2The date of receipt (by mail or e-mail) of the written notice of withdrawal is decisive. 3If a registration is withdrawn less than 15 days before the first day of the course, the paid course fee will be refunded minus an expense allowance of 15 EUR. 4If a registration is withdrawn less than 8 days before the first day of the course, 50% of the course fee will be refunded. 5If a participant fails to show up for the course without a written request to withdraw, the full course fee will be retained without compensation.

§5 Attendance

1Course lessons not attended cannot be paid for and cannot be made up. 2The withdrawal of a participant from an ongoing course does not entitle the participant to a refund of the fee paid. 3If the participant is demonstrably prevented from attending more than half of the course hours through no fault of his/her own, the unattended course hours can be made up by the prevented participant at no additional cost with the consent of the provider. 4A basic claim to make up course hours according to §5 sentence 3 does not exist.

§6 Exclusion from the course

1The continuation of an ongoing course participation can be refused by the provider in justified cases. 2In the event of a participant being excluded from the course prematurely for good cause, the corresponding remaining pro rata course fee shall be refunded. 3The customer will be charged an expense allowance of EUR 10.00 for the refund.

§7 Liability

1Participation in the course is at your own risk. 2The provider assumes no liability for injuries and damages of any kind incurred during participation in the course or as a result thereof, directly or indirectly. 3The provider is not liable for valuables brought along. 4The participant's parents/guardians shall be liable for any damage caused by the participant to the course rooms and access routes as well as to the inventory.

§8 Media use and data protection according to DSGVO

1The provider has the right to make picture and film recordings of the course operation during the course times. 2The provider may use and publish the picture and film material taken during the course for advertising purposes in print and digital media (Internet, homepage, social networks, etc.) free of charge and without time limit. 3The creation of image and film material by customers and guests on the business premises is only permitted after consultation with the provider. 4The publication of picture and film material created according to § 8 sentence 3 may only take place with the written permission of the Provider. 5The visitor of the website agrees to the use of cookies by the website. 6By registering for the courses offered, participants and their legal guardians agree to the storage of their personal data (in printed and digital form).

§9 Participation actions

1Winners of participation promotions such as film and image submissions (or uploads to Facebook groups or similar storage locations) will be determined internally by drawing lots. 2Winnings are non-transferable and cannot be paid out. 3All submitted film and image materials may be used, stored, edited, modified and published by KidZ Training Deutschland for an unlimited period of time and free of charge for advertising purposes in print and online media. 4Participation in the promotion is limited in time and may be terminated without notice. 5There is no entitlement to participation and/or distribution of prizes. 6The legal process is excluded.

§10 Validity

1The invalidity of one point of the contract does not affect the validity of the remaining points of the contract. 2There are no verbal side agreements. 3All contractual agreements must be in be in writing. 3If one point of the GTC is invalid, the remaining points shall remain valid. 4The substitute provision that comes closest to the invalid point shall apply.

§11 Online courses

1Participation in online courses of the provider is at your own risk. 2The provider assumes no liability for any damages, accidents, injuries, consequential damages or the like. 3Participants in online courses are responsible for their own health and the safe imitation and execution of all exercises contained in the courses.

and, if necessary, should undergo a health examination by a competent physician at their own expense prior to participation. 4Online courses are activated for a period of 1 month, 4 months or 12 months. 5The duration of activation may vary depending on the course.

§12 Cancellation clause

1When ordering an online course (digital product), the buyer expressly waives his 14-day right of withdrawal from the purchase contract. 2The digital product ordered is usually made available within a few minutes. 3Non-use of the purchased digital product does not entitle the purchaser to reclaim the purchase price, even if the use within the unlocked usage period was caused by technical defects for which the provider of the product is not responsible.
